  2. So, it looks like some of the lucky legal renters are holdouts. Any chance the board will revoke their rental rights to give some others a chance? Especially the two who are renting two units? I can't find anything in the condo docs that really governs renting.

    1. Not sure how easily that can be accomplished legally. There should be something stating that the leaser must be current or stay current on HOA dues or lose the right to lease. I hope that's the case and if not it should be a condition. In the chance that this sale does not go through I suspect there will be delinquencies that will start to add up if there are increases in dues and special assessments, which seem likely. It would be crazy to imagine that an owner has the benefit of leasing a unit and to be behind on their HOA dues. Please Board, tell us that is not the case!

  3. My strategy is to work on your contacts/neighbors/friends on this list. I have reached out to two people on this latest list, one has said they have mailed their contract, the other said they signed already, so I will research further. Look at the list - email/call/text/Facebook etc your contacts/neighbors/friends on here. I personally know 5 people in the building and will make sure they all have signed. If everybody does that, we can finish this up quickly.

    1. NO . GOOD . REASON. i heard said that one person was holding out because they couldn't take their appliances with them. Are you kidding me? If that is true, it's disgusting. Holding out for a $800 stackable washer/dryer? Give it a break and wake me up when this nightmare is over.

    3. Lets say you have 6000 talking Alexa appliances that order your groceries for you, move them to a friends house, go down to the restore and get some scratch and dents. Sign your contract. If the deal falls through, sell your scratch and dents to one of us who still has their OG 2001 appliances. Profit either way.

    4. Keep the washer/dryer (or whatever appliance you have created an emotional bond with) and pay hundreds and thousands of dollars more in increased HOA fees and special assessments for the privilege of staying here. Makes perfect sense to me....

    5. For those worried about the separation anxiety cause by leaving your appliances, fixtures and upgrades, rip it out now and place in storage until deal goes through. In the meantime, set up a visitation schedule to make sure those material effects remain emotionally bonded to you and you to them! Problem solved! Sometimes it takes a creative solution to solve a needlessly challenging problem!

  5. ��I am very disgusted by the inability of a few people to not realize that we all will be in trouble if this sale does not happen. Their irrational behavior is upsetting. It is my hope that the buyer will start to close on the units willing to sell and turn those properties into rental units. For those not signing, lets see how many remain unsigned.

    1. Don't hold you breath for that to happen. The developer has plans for the building and won't gamble 28 million on the off chance that a hand full of people will eventually come to their senses and sign. I know I wouldn't. This is second attempt at assemblage and one would think the reasons for it to go thru are a lot more compelling than last time. I can't for the life of me understand the reasons one would have to want to stay in this building.

    2. You may be right. I will not hold my breath.
      I will withhold my HOA fees and assessments if this deal does not go through. I will not pay another red cent for a building that is a financial sinkhole.

      Also, to recoup what is lost as result of the inability to sell the property, I will turn my unit into an AirBnB.

  6. I think that many who have not signed are purposefully not looking at the blog or engaging with those of us who sign. It is imperative that we come up with strategies to encourage a dialogue with those remaining unsigned. Please post your strategies and then maybe some of us can implement those strategies to help see this project to fruition. We will not be defeated by the ignorance of some!

    1. Totally agree. Those the most concerned by this discussion are not looking at the blog. I was under the assumption that floor captains were assisting on this task, knocking on doors and initiating conversation to address concerns. Additionally, there are some that have the good fortune of having renters in their units and aren't even on property so need to be contacted in other ways. Since we aren't privy to their phone numbers I imagine the brokers are working behind the scenes to initiate contact and conversation with those. The efforts need to be put in high gear. There are 25 people that we are talking about here.

    2. Uh. What are the board members doing? They have already taken a stand for the sale of the building so are not impartial. I'm not suggesting they are not involved behind the scenes, I don't know.They are the best placed to reach out since they have all contact information I imagine. The primary purpose of the blog is to inform, not vent. I think we need to have more information from those in positions to give it - the Board and Brokers. Is there an organized proactive strategy in place or is it just a reactive one based the signing updates we receive here? Let's not kid ourselves the commentary here is not reaching intended audience.

The board members are dealing with a broken trash compactor, piling up trash, security, stolen vehicles, washing blood off the front sidewalk, the never ending dog shit left everywhere, owners who don't leash their dogs, pot-bellied pigs, used condoms on the roof, vomit in the stairwells, flooding, resident drug dealers, repeated water shutoffs, stolen packages, stranded people in broken elevators, half the landscaping flooding the pool when it rains, rats, water leaking from somewhere, homeless people sleeping in the basement and gym closet, the fire alarm going off at all times of day and night, listening to sob stories of why owners can't pay their dues, cars parked in fire lane and 2hr parking for days, broken gates, renters brandishing guns, removing abandoned furniture from basement, fixing the back fence, taking care of their families, taking care of themselves, working full time jobs, enjoying life - all while - voluntarily - being on-call 24-7 for a building of 130+ people whose only contribution is to the complaint box.

      I'm not on the board. I'm a grateful owner.

      Please direct your frustrations at the greedy, ego-maniacs who are holding up the deal.

    4. I am a grateful owner. The response was a bit of overkill. I was simply asking if the board is working behind the scenes on things we don't know about since they have more resources than we do as to contact persons that do not live on property and since they are in first line contact with Brokers. I am fully cognizant that without the Board things would be a lot worse than they are, they are holding a sinking ship together.

    5. Then just ask is there anything the board can do to help in contacting the hold outs? Is there anything we can do? Some sort of plan of action? When you start with 'Uh' you are going to get the response you got. I have been on a board before and it is the most thankless job that will quickly turn your optimism into pessimism and ruin your faith in people. Not overkill. Just the way it is.

  8. Can you tell this person that the contract just says appliances? Nobody is going to ensure they're the ones that are in the unit while they're living there. Nobody is going to take pictures or write down serial numbers. They simply wasn't working appliances. Not every unit has a washer and dryer, so ignore that. Leave a stove, dishwasher, and refrigerator. (Some were base model white. Some are 17 years old. Get something off Craig's list. Put them in on day 365 of your rental period, or whatever day you move out.)

    Problem solved and no need to be separated from your appliances.

  9. I do hope that the buyer is motivated enough to close deals and simply squeeze out any holdouts. With over 7O% of the units, they'd own the HOA and all the seats on the board. They could increase fees and make exorbitant special assessments, as well as decrease offers to holdouts. They might not be willing to do it, but it's a strategy and it would be effective. A church nearby used that tactic. The last ones out got LESS than the first ones.

    If those who live there could collect reasons for not signing, we could create an FAQ with valid responses. Share those.

    Josh told me that we have about 10 owners being, "difficult". I hope he's able to get through to them, and that we figure out what they really need.

    Do they need to feel in control? They control when they leave and where they go next.

    Do they need to feel powerful? They have the power to get this deal done by joining those who have signed.

    Do they need to feel safe? They can move to another place with better amenities, including security.

    1. Honestly, I can't imagine it has to do with appliances. What a joke if it does. They are not comfortable with the deal, with moving. They are being short sighted about what the future holds here. If we had some real insight as to what is holding people back, and if it is money that they would be honest enough to say so, we can address the other side of argument. Without that information we have nothing to go on.

    4. Being well known and respected would be a benefit. I'm not suggesting they do anything other than make a deal they AND 80% of owners want to happen. I'll be beyond disappointed if a group of well known and respected business people let' a few people ruin this deal for all of us, including future residents of the building.

    8. I believe our contracts are not written in such a way that the buyer would obtain individual units. It's all or nothing. Additionally, no well-respected development group is going to pull a squeeze on a building like this. There's no gain for them. They take an image hit, and it'll cost them additional time with no deadline. Their time costs them money, they can't have their capital and credit tied up in some speculative deal with no expiration date. They can and will take their capital and invest it elsewhere if we do not get everyone to sign.

  10. I have been on the fence about sharing this or not. I personally know one of the unit owners 100% wants to sign, but is intentionally playing games. This individual told me he/she is going to basically hold their feet (Josh and Shawn) to the fire by demanding more money. Going so far as to say they will demand their commissions not be taken out of the sale of their unit, and of course....trying to get more money.

    First off anyone who has been in sales knows they aren't doing this for free. I used to sell cars in my 30's, and I always had people trying to weasel out of paying me a commission saying stuff like "Oh come on....you can knock off another $5000 from a 17k vehicle mind you that was already reduced significantly.

    This is genuinely dishonest and irresponsible. I keep waiting for this individuals unit to pop up as signed, but I assure you that if this person screws this up for my family I will personally post on this blog...IN DETAIL exactly who that person is and what games they were playing. It won't stop there though. I will make it very well known among the residents who you are, and the "stuff" you've been up to at SOBU that I'm sure a certain department would love to know about...if you catch my drift.

    You know who you are, and I assure you I will expose you. It's not a promise. It's a FACT.

    Furthermore, stop saying you deserve more money for your unit! Nobody has been able to get fair market value for their home in forever. Josh has brought us investors that will pay us well beyond that. I think it's 60 or 70 percent more. Let that sink in! You saying your unit is all fixed up doesn't mean crap. You brought your unit up to standard, which all sellers have to do to get a fair market value, but that's still not happening. It doesn't take away from the fact that our building is falling apart and we're all going to be assessed a ton of money soon, which I cannot afford much like the rest of you.

    "My unit is so nice though!" Great....you're a diamond in the middle of a giant pile of crap. Nobody wants to live like that.

    Sign your contracts people. Be smart. This is the best deal for all of us, and a hell of a one at that. It's honestly the equivalent of someone coming to my dealership and purchasing the most beat up car we have. The one nobody wants because it has so many problems, yet the buyer tells you they will pay you 150% of it's original sticker price.

    WAKE UP PEOPLE!!!! We're all going to be broke and in so much financial trouble if this doesn't happen.

    Knock on the doors of these people and tell them to sign. Not signing is the definition of insanity! Even a dumb businessman is smart enough to see this offer is literally a godsend.

  11. Unfortunately, this holding out will happen every time there is an attempt to assemble. We just need to make it crystal clear that all will burden financially if this deal does not happen. Paces Green has sold. The building on corner has sold! Who in their right mind would want to stay here admid all the new construction? Who? Please make yourselves known.

  12. I know its difficult not to "vent" on this blog but other than making the poster and others feel good in the present it is not the best way to use our energy in seeing this through. Josh, board members and others are working hard to make this happen and threats etc..aren't going to accomplish anything. Lets focus our energy on the folks who haven't signed yet and LISTEN to what there issues are and overcome them with intelligent respectful communication. I like many of you have a hard time not checking this blog daily (patience has never been a strong suit) but lets trust the process for now we are not even 30 days in yet. I remain hopeful the assemblage happens.

  13. It's a game to the holdouts and it looks like it will get nasty. Over 100 owners are signing over what has been their home and community for years for all the reasons exposed here. It's not an easy decision but the right one. We have made it and are able to move on. We have been invested in the building and community and it's over. The holdouts have a completely different agenda that is hard to grasp and we are all caught up in the manipulating scheme. Many people will suffer for it and their short sightedness will end up costing them also. Hard to tell if they give a damn.

  14. Both comments are well put. I too believe that this assemblage will eventually happen and by the deadline date. I have faith that the people who are holding are not ignorant of the facts and the reality. We have time. Let us please concentrate our efforts on encouraging those unsigned to sign expeditiously. The unsigned don’t need the writing on wall to be made clearer. The unsigned need to have the pen placed in their hand.

  15. Would it be helpful for people to “sign up” and talk to the people who have not signed so they are not overwhelmed by the amount of people reaching out to them? I know a “floor leader” has been mentioned before, but did that happen? If not, we could reach out to the people we know and then there won’t be much more guessing.

    1. Could it be that the "holdouts" are trying to extend the date that they live(or rent) in the unit for the longest possible period? Is it not true that the one year lease back period begins to toll from the date the LAST contract is signed? Perhaps their goal is to squeeze all the "juice" they can from their situation. It might help motivate the holdouts to sign by stating that the one year period starts on the expiration date of the offer for everyone regardless of the date the individual contract was signed.

    2. People have already agreed to have a dialogue with the difficult owners. Some owners have technical issues that need and will be resolved soon. There are only really a small ridiculously resistant contingent. However, those resistant owners will eventually sign. Stay focus, patient, civil and with resolve. This deal will happen!

  16. Don't think it is Josh's decision. The developer has a price in mind which they offered and it was calculated out to a price by square foot. Not a lot of wiggle room there. They way it was presented the brokers have to be consistent in the deal, they have published what everyone's offer is based on their square footage. Any play would have to be from a commission stand point or changing lease conditions I would imagine, don't quote me. Not so naive enough to not realize that side deals are common in business, but can you imagine the situation if it got out that some were negotiating and got higher per square foot prices after we were not it could not happen?

    1. Unsettling is that none of the unsigned have made any type of comment, defensive, offensive or otherwise to this blog. The only way we can resolve their issues is if we know their issues. The holdouts should, therefore, speak up and let their concerns be known.

  18. Someone please provide an update. Agents, please give us a realistic likelihood of this deal being completed. It seems to have stalled by all indication. Also, individuals who said they would sign gave not done so yet. What is their major issue(s)?
